Privacy
This site is built to collect as little as possible. Here is exactly what happens when you visit.
Who is responsible
movingelements.ro is the official website of the artist Moving Elements. It is run by MOVING RECORDS S.R.L., registered office Str. Vasile Alecsandri 76, 510201 Alba Iulia, Alba County, Romania; Trade Register no. J01/790/2016; tax ID 36516097. MOVING RECORDS S.R.L. is the controller of the personal data described on this page. Contact: records@movingrecords.ro.
Your choice, first
Statistics and marketing load only after you choose in the cookie banner. Players from other services and our mixes load only when you press play (see below). In the banner you can accept everything, reject everything, or choose in Settings, and change your mind at any time from “Cookie settings” at the bottom of every page. Withdrawing consent stops further collection; it does not affect what happened before. Legal basis for statistics and marketing: your consent (Art. 6(1)(a) GDPR and Art. 4(5) of Romanian Law 506/2004).
Statistics (only with your consent)
If you allow statistics, we use two tools to count visits and see which pages and music people use. They process this data on our behalf.
- Metricool (Metricool Software, S.L., Spain) sets no cookies, does not store your IP address and keeps its data in the EU, only as long as we need it for these statistics. Metricool privacy policy (opens in a new tab).
- Google Analytics (Google Ireland Limited) sets its own cookies (
_gaand_ga_*) and does not log or store IP addresses. We keep user-level and event-level Analytics data for 2 months; aggregated reports are kept longer. Google may transfer data to Google LLC in the United States, which is certified under the EU-U.S. Data Privacy Framework. How Google uses data from sites that use its services (opens in a new tab).
Marketing (only with your consent)
If you allow marketing, we use the Meta Pixel. It sends Meta information about your visit, such as the pages you view, the time, your browser and device, and Meta cookie identifiers, so we can measure our ads and show them on Facebook and Instagram to people who visited this site.
For collecting this data on our site and sending it to Meta, we and Meta Platforms Ireland Limited (Merrion Road, Dublin 4, D04 X2K5, Ireland) are joint controllers (Art. 26 GDPR). Under our agreement with Meta (the Controller Addendum (opens in a new tab)), we are responsible for asking your consent and informing you, and Meta handles your rights for the data it stores. What Meta does with the data after it receives it is decided by Meta alone, as described in its privacy policy (opens in a new tab). Meta may transfer data to Meta Platforms, Inc. in the United States under the EU-U.S. Data Privacy Framework and standard contractual clauses. Besides “Cookie settings” here, you can manage ad preferences in your Facebook and Instagram settings or at youronlinechoices.eu (opens in a new tab).
Players from other services (only when you ask for them)
YouTube, YouTube Music, Spotify, Apple Music and SoundCloud players are not loaded when a page opens. They load only when you press play or open the live stream. From then on, that service receives technical data such as your IP address, may set its own cookies (SoundCloud, for example, sets a long-lived identifier and runs an anti-bot check) and may transfer data outside the EU under its own safeguards. For loading the player and sending this technical data we and that service are joint controllers; what the service does next is up to it alone, as described in its policy. Legal basis: our legitimate interest in playing the music you asked for (Art. 6(1)(f) GDPR). Policies: Google / YouTube (opens in a new tab), Spotify (opens in a new tab), Apple (opens in a new tab), SoundCloud (opens in a new tab). The 30-second track previews are streamed directly from Apple when you press play on a track.
Music playback
Episodes of The Journey podcast and other mixes stream from our media storage (today Digi Storage, in Romania; later our own server) only when you press play; the storage receives your IP address to deliver the file. Legal basis: our legitimate interest in playing the music you asked for (Art. 6(1)(f) GDPR). The audio-reactive visuals are calculated in advance, so your browser does not analyse or send anything about what you listen to.
Stored on your device
Your choices are kept in your browser's local storage, not sent anywhere: motion and visuals settings, the Bluetooth sync delay, your cookie choice, and whether you have seen the visuals notice. You can clear them from your browser settings at any time.
Hosting
The site runs on a server at OVH SAS in France (Strasbourg data centre) and is delivered through the network of Cloudflare, Inc., which protects it and speeds it up. Like any web service, they briefly process technical data such as your IP address on our behalf, to deliver the pages and protect against abuse. Legal basis: our legitimate interest in running a secure site (Art. 6(1)(f) GDPR). Server logs are kept for 30 days. Cloudflare may process data in the United States under the EU-U.S. Data Privacy Framework. Fonts and images are served from this site, not from third parties.
Your rights
Under the GDPR you can ask us for access, rectification, erasure, restriction or portability of your data, object to processing, and withdraw consent at any time. Write to records@movingrecords.ro. For data Meta stores after the Meta Pixel sends it, you can also contact Meta directly. You can complain to the Romanian data protection authority, ANSPDCP (opens in a new tab).
